I receive email from Zulily which is another of the millions of “daily deal” sites that are out there. Zulily specializes in baby and kids clothes and accessories. I signed up because we have a couple of friends and relatives with little ones, and it seemed like I might be able to pass them a deal. I was disappointed on a couple of levels.
1. The daily deals are just long and poorly designed emails that I ignored after about 3 of them.
2. They come every single day.
3. The best part. Zulily is in violation of the law. They have decided they don’t need to comply with the CAN-SPAM Act of 2008.
Zulily requires you to login in order to unsubscribe. This is clearly a violation of the 2008 update. The text from the FTC.
Honor opt-out requests promptly. Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. You can’t charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once people have told you they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list. The only exception is that you may transfer the addresses to a company you’ve hired to help you comply with the CAN-SPAM Act.
I can’t get out without logging in. I honestly don’t understand this logic. Why do you want to try and keep someone around who no longer wants your email? Wanna guess what comes next for me? That’s right, I will report this message as spam every single day.
